Users must respect payment authority, third-party rights, privacy, safeguarding and site security. We may proportionately moderate prohibited prompts, restrict compromised Accounts and investigate abuse. Good-faith disputes, consumer remedies and privacy rights are not prohibited conduct.

1. Scope & relationship with other documents

1.1 This Acceptable Use Policy applies to browsing the Picwave website, creating an Account, purchasing catalogue Digital Images, buying Generation Credits, entering prompts, using reference material, receiving generated files and communicating through the Service. It is issued by WERVIX LTD trading as Picwave.

1.2 The Terms & Conditions govern contractual rights and licences, the Payment Policy addresses card transactions, the Refund Policy governs remedies and the Privacy Policy explains personal-data processing. A breach of this Policy may be a breach of the Terms, but mandatory consumer and data-protection rights are preserved.

1.3 We interpret prohibited conduct proportionately and based on available evidence. New technology and harmful-use patterns can emerge; a reasonable security or safeguarding restriction may be imposed to prevent a demonstrated risk even when a particular technique is not named word-for-word.

2. Core principle of permitted use

2.1 The Service supports personal and commercial creative work such as marketing images, product concepts, artwork, mood boards and editorial design, subject to a lawful licence and appropriate clearance of third-party rights. A user may modify and incorporate purchased files as permitted by the Terms & Conditions.

2.2 Use must comply with laws relevant to the user, material and intended publication, and must respect the rights and safety of identifiable individuals. Artistic intent is not a defence to privacy invasion, impersonation, exploitation, intellectual-property infringement or illegal advertising.

2.3 A user is responsible for reviewing AI outputs before publication for factual inaccuracies, misleading endorsements, sensitive traits and potential rights issues. We do not guarantee that an AI-generated output is unique, copyright-protectable or appropriate for every business sector.

3. Account integrity & identity

3.1 Register only if you are 18 or older and provide accurate details. Do not create Accounts using a stolen identity, share access credentials, sell logins, automate account creation to evade limits or attempt to gain access to another customer’s order or generation history.

3.2 Keep passwords and authentication codes confidential, and notify info@pic-wave.com if access appears compromised. We may request reasonable re-authentication or temporarily suspend access to protect an Account. An inaccurate contact email may also prevent delivery of important security or purchase notices.

3.3 Creating duplicate Accounts to bypass suspensions, obtain repeated introductory promotions or move purchased credits to a banned profile is prohibited. Good-faith recovery of a mistakenly closed profile must be requested through support rather than by misrepresenting identity.

4. Prohibited payment / checkout behaviour

4.1 Do not use stolen or unauthorised payment instruments, falsify transaction evidence, manipulate basket totals, apply discount codes without entitlement, tamper with payment flows or submit repeated payment requests with the intention of exploiting a checkout race condition.

4.2 Knowingly false chargeback allegations or deliberate efforts to keep both a refunded digital entitlement and the full payment constitute misuse. However, a good-faith refund claim or exercise of lawful bank or card-scheme dispute rights is never, by itself, treated as prohibited behaviour.

4.3 Credits cannot be used to launder value, cash out money, exchange for legal tender or pay unrelated third parties. Payments must occur only through the authorised checkout channel and cannot be redirected to support personnel or independent wallets.

5. Prohibited gameplay / fair-use abuse

5.1 Do not manipulate the generation-credit ledger, repeatedly replay the same request to obtain multiple results from one credit, interfere with account balance checks or deliberately exploit errors in order or fulfilment systems.

5.2 Automated request storms, excessive concurrent prompt submissions designed to degrade availability and evasion of rate limits are prohibited. A user may generate many lawful images using legitimately purchased credits within published technical constraints.

5.3 A failed generation due to a verified Service error should result in credit restoration or another remedy. Customers may report balance mistakes and are not prohibited from requesting correction; abusive exploitation of a known defect is distinguished from a reasonable dispute about one’s entitlement.

6. Prohibited technical interference

6.1 Do not probe for vulnerabilities without authorisation, execute denial-of-service attacks, inject harmful scripts, upload malware, intercept another person’s session, circumvent authentication or attempt to read hidden files, secrets, model internals or payment information.

6.2 Scraping catalogue content in bulk, bypassing robots or anti-bot measures, duplicating the product database and reverse-engineering access controls for commercial harvesting are prohibited, except where a mandatory legal exception applies. Reasonable ordinary browsing and search indexing permitted by site controls are not treated as misconduct.

6.3 If you identify a possible security issue, contact info@pic-wave.com with a concise description and refrain from accessing data that is not yours. Do not disclose private customer material or publish exploit details that would create avoidable harm.

7. Content conduct & communications standards

7.1 Do not submit prompts or reference images intended to produce unlawful sexual exploitation of children, non-consensual intimate imagery, coercive sexual content, threats of violence, targeted harassment, hateful abuse, deceptive impersonation, fabricated criminal evidence or instructions to commit harm.

7.2 Do not create misleading images of real persons giving product endorsements, political statements or financial recommendations without necessary permissions and disclosures. The obligation to obtain consent for an individual’s likeness, privacy, intellectual property or personal data remains with the submitting user.

7.3 Communications to staff and other users must not include threats, doxxing, abusive contact campaigns or fraudulent requests for confidential information. A robust complaint, a rights allegation or a refusal to accept a refund decision can be expressed firmly without becoming prohibited conduct.

Davranış

Neden yasaklandı?

Muhtemel yanıt

Non-consensual intimate portrait

Serious privacy and safety harm

Reject output, restrict access, investigate

Child exploitation prompt

Unlawful exploitation/safeguarding

Block, escalate where legally appropriate

False celebrity endorsement

Deception and publicity-rights harm

Remove or restrict, request clarification

Stolen card or forged chargeback

Payment fraud and scheme abuse

Hold and investigate contested transaction

Automated credit duplication

Unauthorised service use

Ledger correction, access restriction

Bulk catalogue scraping

IP and infrastructure misuse

Rate-limit or block extraction

Good-faith refund complaint

Not prohibited

Normal refund review and statutory rights

Security report without intrusion

Not prohibited

Coordinate responsible investigation

8. Intellectual property & unauthorised commercial exploitation

8.1 Only upload images, designs, trademarks, prompts or reference content for which you have the rights or another legal permission needed for the intended transformation. Do not remove watermarks or ownership notices from third-party material or use the generator to imitate protected commercial assets unlawfully.

8.2 The purchased image licence permits lawful end use and adaptation but does not permit operating a competing stock-image site by republishing Picwave source files unchanged. You may not claim ownership of Picwave software, model weights, catalogue selection or branding.

8.3 A generated output can resemble existing content by chance. You should undertake appropriate rights clearance for high-risk commercial use. We may act on credible third-party notices while allowing affected users to provide lawful counter-evidence or explanation.

9. Account trading, transfers & virtual-goods misuse

9.1 Generation Credits are personal prepaid usage entitlements and may only be used through the legitimate Account and authorised generator. They must not be sold, gifted via unofficial account exchange, pledged, rented, converted to cash or marketed as a virtual investment.

9.2 Reselling a login, pooling unauthorised accounts to bypass purchased limits or running an unofficial third-party service that redeems Credits on behalf of anonymous clients without permission can undermine fraud, licence and consumer safeguards and is prohibited.

9.3 On a lawful refund, relevant unused credits are reversed; on voluntary Account closure unused balances ordinarily become unusable, subject to statutory and applicable goodwill rights. A customer may challenge an inaccurate credit debit or other ledger issue through the Refund Policy.

10. Children, age & protective restrictions

10.1 The Service and all purchase and generation features are restricted to adults aged 18 or over. Do not encourage a minor to bypass registration or payment restrictions, use an adult’s saved payment method without authority or supply the platform with a child’s private information without lawful grounds.

10.2 Any actual or synthetic image depicting a minor in a sexualised, exploitative or unlawful context is strictly prohibited, as is generation intended to groom or endanger a child. We may preserve limited evidence and report credible serious exploitation where required or permitted by law.

10.3 We may take proportionate measures to prevent unsafe generation or remove unlawful content. Protective restrictions do not authorise arbitrary retention of a child’s data or denial of mandatory payment and consumer remedies owed to the relevant payer.

11. Reporting, investigations & cooperation

11.1 Report suspected misuse, infringement, non-consensual likeness or security compromise to info@pic-wave.com, identifying the affected URL, Order or material where available. Do not distribute harmful content further in order to draw attention to a complaint.

11.2 We may review relevant prompts, Account activity and payment or generation logs to determine the nature and seriousness of a reported issue. Any personal-data processing must have a valid legal basis and be proportionate; sensitive details should be restricted to authorised investigators.

11.3 We may cooperate with competent law enforcement, court orders, banks and appropriate authorities within the limits of law. A user can supply an explanation, report an error or seek a review without being required to confess wrongdoing or relinquish a valid legal right.

12. Enforcement measures

12.1 Responses depend on risk and evidence and can include guidance, content rejection, warning, removal of prohibited material, rate limiting, extra verification, temporary restriction or closure of an Account. Serious immediate harm may justify rapid action before ordinary notice.

12.2 Where feasible, affected users will receive a reason and the route to request review. We aim to avoid disproportionate permanent bans arising solely from ambiguous moderation signals. Any corrective action involving paid Credits is assessed separately under the applicable consumer and refund provisions.

12.3 Repeated deliberate fraud, security attacks, exploitation of minors and other serious unlawful conduct may be referred to authorities or cause termination. A legitimate refund request, privacy complaint or chargeback is not alone sufficient grounds for punitive termination.

13. Relationship to refunds, cancellation & data requests

13.1 The Refund Policy governs whether a paid Digital Image or Credit pack qualifies for repair, replacement, refund, price reduction or commercial concession. A breach allegation cannot erase an independent statutory remedy for defective or undelivered content.

13.2 The Cancellation Policy explains voluntary closure and the effect on outstanding Account entitlements. Closing an Account may not defeat a bank dispute, consumer withdrawal right or a pending request to access or erase personal information under the Privacy Policy.

13.3 We may retain necessary security, payment or claim evidence for a lawful period even after closing an Account. Such retention is not permission to use a customer’s prompts for unrelated marketing or model training without a valid lawful basis.

14. Amendments & version control

14.1 This Policy is reviewed when moderation technology, safety standards, law or commercial functionality materially changes. We publish a current version and effective date on pic-wave.com and communicate material revisions by an appropriate notice where required.

14.2 An update cannot retroactively convert good-faith lawful past conduct into a breach that justifies deprivation of an accrued statutory remedy. Urgent restrictions may still be necessary to prevent ongoing harm under current applicable law.

14.3 The law of England and Wales governs the contractual provisions of this Policy subject to mandatory consumer and privacy protections applying elsewhere. Disputes may be raised through support or a competent court where permitted by law.

15. İletişim

15.1 Send acceptable-use, copyright, personal safety or technical abuse reports to info@pic-wave.com with a concise explanation and evidence sufficient to locate the issue. Do not include passwords, complete card details or unnecessary copies of intimate imagery.

15.2 The operator is WERVIX LTD, company number 17499009, registered at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. The website contact form is available at https://pic-wave.com/contact-us/.

15.3 For billing concerns refer to the Payment Policy and Refund Policy; for personal-data requests refer to the Privacy Policy. Appropriate escalation to a regulator, card issuer or court is not restricted by this acceptable-use standard.

Illustrative Examples of Unacceptable Use and User Good-Faith Expectations

A prompt seeking to create a fake endorsement by an identifiable person without consent, a deceptive fake identification card or a non-consensual intimate scene is prohibited even if the customer has purchased Credits. A moderation rejection does not authorise attempts to disguise the same request.

An automated script that purchases one Credit but triggers repeated deliveries, accesses another customer’s image history or interferes with checkout security is prohibited. A customer who believes a legitimate generation failed may instead report the request reference and seek restoration of the associated credit.

A customer can lawfully express dissatisfaction, request a refund for defective content, dispute a card transaction in good faith and object to personal-data processing. Such conduct is not an account-abuse violation. We consider each request based on facts and applicable law.

Before publishing commercially, check whether a generated image uses a real person’s likeness, a protected brand or a context requiring special disclosure. The Picwave licence does not replace permissions from third parties, and AI output is not guaranteed legally exclusive.

Picwave | Acceptable Use Policy | v1.0 | Effective 8 October 2026.
