Important: Use of the Picwave platform is permitted only for lawful purposes and in accordance with these rules. Misuse — including submission of harmful prompts, chargeback fraud, account manipulation, and automated scraping — will result in Account suspension or termination and may be reported to relevant authorities. Picwave is committed to maintaining a safe, fair, and high-quality creative platform for all users.

1. Scope & Relationship with Other Documents

1.1  This Acceptable Use Policy (“AUP”) sets out the rules governing what users of the Picwave platform may and may not do. It applies to all use of the Service at pic-wave.com, including browsing the Shop, purchasing Digital Images, purchasing Token Packs, using the Generate Module, and interacting with the platform in any other way.

1.2  This AUP forms part of the agreement between you and Company name (“Picwave”, “we”, “us”). It supplements the Terms & Conditions, Privacy Policy, and other policies available at pic-wave.com, all of which are incorporated by reference. In the event of conflict, the Terms & Conditions shall prevail.

1.3  By using the Service, you confirm that you have read, understood, and agree to comply with this AUP. Breach of this AUP is a breach of your agreement with Picwave and may result in the enforcement measures set out in Section 12.

2. Core Principle of Permitted Use

2.1  The Picwave platform exists to enable users to access, purchase, and generate AI-created visual content for personal and commercial creative projects. Permitted use is use that is: (a) lawful in the jurisdiction where you are located; (b) consistent with these Terms; (c) respectful of the rights and safety of other people; and (d) aligned with the creative purpose of the platform.

2.2  Everything that is not explicitly prohibited by this AUP or by applicable law is generally permitted, provided it falls within the scope of legitimate creative and commercial use as described in Section 5 of the Terms & Conditions.

2.3  Picwave reserves the right to determine, in its reasonable judgement, whether any specific use falls within or outside the scope of permitted use, and to take action accordingly.

3. Account Integrity & Identity

3.1  You must register an Account using your real identity and a valid email address. Providing false or misleading information to register an Account is prohibited.

3.2  One Account per person. You may hold only one Account at any time. Creating multiple Accounts for any purpose — including to exploit promotional offers, accumulate bonus Tokens, or circumvent an Account suspension — is prohibited.

3.3  Account credentials are personal to you. You must not share your login credentials with any other person. You are responsible for all activity conducted through your Account, whether or not authorised by you.

3.4  If you believe your Account has been accessed without your authorisation, notify us immediately at info@pic-wave.com and change your password.

4. Prohibited Payment / Checkout Behaviour

4.1  You must not:

• Use a payment card, bank account, or other payment method that you do not have authority to use for this transaction.
• Use fraudulently obtained, stolen, or otherwise compromised payment credentials.
• Initiate a chargeback or payment dispute for a transaction that you authorised and for which Picwave has fulfilled its obligations, as a strategy to obtain products without payment (commonly referred to as ‘chargeback fraud’ or ‘friendly fraud’).
• Attempt to manipulate the checkout process to obtain a lower price, apply invalid discount codes, or bypass payment verification steps.
• Make purchases with the intention of immediately requesting a refund as a means of obtaining free use of the Service or the Generate Module.

5. Prohibited Gameplay / Fair-Use Abuse

5.1  You must not abuse the Token or Generate Module systems in the following ways:

• Purchasing Token Packs, using all or most of the Tokens, and then claiming non-delivery or defect as a pretext for a refund.
• Using bulk Token purchases for the purpose of re-selling generated images as stock photography in a manner that violates Section 9 of the Terms & Conditions.
• Using the Generate Module to systematically generate images at scale for the purpose of training or fine-tuning third-party AI models, without express written permission from Picwave.
• Using promotional Token offers (if available) through multiple Accounts to accumulate Tokens beyond the intended entitlement per user.

6. Prohibited Technical Interference

6.1  You must not:

• Use bots, scripts, spiders, crawlers, or other automated tools to access the Service at a rate or volume beyond normal human browsing, or to scrape content from the Shop or the Generate Module at scale.
• Attempt to reverse-engineer, decompile, extract, copy, or otherwise access the underlying AI models, weights, training data, or proprietary algorithms used in the Generate Module.
• Probe, scan, or test the Service for security vulnerabilities without prior written permission from Picwave’s technical team.
• Attempt to circumvent, disable, or interfere with any authentication, access control, fraud detection, rate-limiting, or payment system.
• Introduce malware, viruses, ransomware, trojan horses, worms, or any other harmful or destructive code into the Service.
• Attempt to gain unauthorised access to the platform’s backend, databases, or administrative interfaces.

7. Content, Conduct & Communications Standards

7.1  When submitting prompts to the Generate Module, you must not request or attempt to generate:

• Any sexual content involving or depicting minors (CSAM or CSEM). This is an absolute prohibition; any attempt to generate such content will result in immediate Account termination and reporting to law enforcement authorities.
• Content that depicts real, identified individuals in a sexualised, degrading, or otherwise objectionable manner without their consent.
• Content that constitutes or facilitates hate speech: material that promotes violence against, or hatred of, people on the basis of race, ethnicity, national origin, gender, sexual orientation, disability, religion, or other protected characteristics.
• Content designed to harass, intimidate, or cause distress to a specific individual.
• Non-consensual intimate imagery (sometimes referred to as ‘deepfake pornography’) depicting real individuals.
• Content designed to create or disseminate disinformation, particularly in relation to elections, public health, or the identity of real individuals.

7.2  When communicating with Picwave support or in any other platform interaction, you must not use abusive, threatening, or harassing language directed at Picwave staff or other users.

8. Intellectual Property & Unauthorised Commercial Exploitation

8.1  You must not use the Service in a manner that infringes the intellectual property rights of any third party, including:

• Submitting prompts designed to generate images that replicate the distinctive style, character, or composition of specific copyrighted artworks, trademarks, or logos in a manner that creates a likelihood of confusion or infringement.
• Using generated or purchased images in a manner that infringes the copyright, trade mark, or other rights of third parties.
• Attempting to claim copyright or other intellectual property rights in generated images beyond the scope of the Licence granted in Section 5 of the Terms & Conditions.

8.2  Picwave provides a licence to use its content; it does not transfer ownership of the underlying intellectual property. Any exploitation of Picwave’s content beyond the scope of the Licence is prohibited.

9. Account Trading / Transfers / Virtual-Goods Misuse

9.1  You must not:

• Sell, transfer, gift, or otherwise dispose of your Account or your Token balance to any other person, whether for money or otherwise.
• Purchase, acquire, or receive a Picwave Account or Token balance from a third party — all Accounts and Token balances must be obtained directly from Picwave.
• Use Tokens to generate images at scale for the primary purpose of selling those generated images on external stock image platforms, competing image marketplaces, or NFT markets in a manner that violates the licence terms in Section 5 of the Terms & Conditions.
• Acquire Digital Images for the purpose of reselling the image files as standalone digital assets on any platform.

10. Children / Age / Protective Restrictions

10.1  The Service is intended for users aged 18 and over. You must not:

• Allow a child under 13 to use the Service without verifiable parental consent.
• Use the Service, or allow it to be used, for the purpose of generating or accessing content that would be inappropriate for the age group of the intended audience.
• Generate content that facilitates or encourages contact between adults and minors for inappropriate purposes.

10.2  If you are a parent or guardian and believe that a child under 18 has accessed the Service without your knowledge, contact info@pic-wave.com immediately.

11. Reporting, Investigations & Cooperation

11.1  If you believe that another user is misusing the Service, or that content on the platform violates this AUP, you are encouraged to report it to info@pic-wave.com with the subject line “AUP Concern” and as much detail as possible.

11.2  Where Picwave conducts an investigation into potential AUP breaches, you must: (a) cooperate fully with any reasonable information requests from Picwave’s support or compliance team; (b) not attempt to delete or destroy evidence related to the investigation; (c) not interfere with the investigation or contact any third parties involved.

11.3  Picwave will investigate reports in good faith and will take appropriate action where a breach is confirmed. We will protect the confidentiality of reports where possible.

12. Enforcement Measures

12.1  Depending on the nature and severity of the AUP breach, Picwave may take one or more of the following actions:

• Issuing a written warning by email.
• Suspending access to specific features (for example, the Generate Module) pending investigation.
• Suspending the Account for a fixed period.
• Permanently terminating the Account and forfeiting any remaining Token balance.
• Refusing future Account registration by the same individual.
• Reporting the conduct to card schemes, payment providers, or law enforcement authorities.
• Pursuing civil or criminal legal action for damages, losses, or criminal conduct arising from the breach.

12.2  Picwave reserves the right to take the action it considers proportionate and appropriate in the circumstances. For serious breaches — particularly those involving CSAM, fraud, or deliberate damage to the platform — immediate termination and law enforcement reporting will occur without warning.

13. Relationship to Refunds / Cancellation / Data Requests

13.1  AUP breaches may affect your entitlement to refunds. Specifically: (a) chargeback fraud is not eligible for a refund; (b) Accounts terminated for breach are not entitled to a refund of their Token balance; (c) abuse of the refund process itself is an AUP breach.

13.2  Account closure following an AUP breach is governed by the Cancellation Policy. Terminated Accounts are not eligible for voluntary closure under the self-service process; the termination is the closure.

13.3  Your rights under data protection law (including the right to access or delete your personal data) are not affected by an AUP breach and remain exercisable under the Privacy Policy.

14. Amendments & Version Control

14.1  Picwave may update this AUP from time to time to address new misuse patterns, platform changes, or legal requirements. Material changes will be notified by email or website notice at least 14 days before taking effect.

14.2  The current version of this AUP is always available at pic-wave.com. The version number and effective date are shown in the header of this document.

Prohibited Behaviour: Key Examples

The following table provides a non-exhaustive list of prohibited behaviours and the likely enforcement response.

User Good-Faith Expectations

Picwave commits to the following in its relationship with users who act in good faith:

• We will investigate AUP concerns raised by you and provide feedback where possible without compromising confidentiality.
• We will provide a warning before taking enforcement action for minor or first-time breaches, except where the breach is serious (fraud, CSAM, deliberate harm to the platform).
• We will process AUP appeals fairly and within a reasonable timeframe (typically 5 business days).
• We will not suspend an Account solely on the basis of an unverified report from another user without conducting our own investigation.
• We will provide clear reasons for any enforcement decision communicated to you, to the extent permitted without prejudicing an ongoing investigation.
• We will treat your personal data in accordance with the Privacy Policy throughout any investigation.

Illustrative Examples of Unacceptable Use

The following fictional examples are provided to help users understand the scope of this AUP:

• Example A: A user (let us call them “ZX”) purchases a Scale Pack (450 Tokens), uses 430 Tokens to generate product images for a client campaign, then emails Picwave claiming the Tokens were never credited. This is chargeback fraud and an AUP breach.
• Example B: A user named “BW” sets up three email addresses to register three separate Accounts and claims the introductory offer on each. This is multi-accounting abuse.
• Example C: A developer “KP” submits a series of prompts specifically designed to probe whether the Generate Module will produce explicit content. Even if no explicit image is produced, probing for safety gaps is an AUP breach.
• Example D: A user “MT” downloads 20 Digital Images from the Picwave Shop and uploads them all to a competing stock photography website. This violates the Licence and is an AUP breach.
• Example E: A marketer “SB” writes a script to download all product images from the Picwave Shop for analysis. This constitutes scraping and is technically prohibited under Section 6.
