Important: Closing your Picwave Account permanently forfeits any remaining Token balance — Tokens cannot be cashed out, transferred, or recovered after closure. There are no subscriptions or recurring charges to cancel. Closing your Account is separate from requesting a refund: refund requests are governed by the Refund Policy. Your statutory consumer rights are not affected by this Policy.

1. Scope & Interpretation

1.1  This Cancellation Policy governs the process and consequences of closing or cancelling a Picwave Account at pic-wave.com. It applies to all registered users of the Service operated by Company name (“Picwave”, “we”, “us”).

1.2  Because Picwave operates exclusively on a one-time purchase basis — with no subscriptions, recurring charges, or ongoing contracts beyond the account relationship — “cancellation” in this Policy means the closure or deletion of your Account, not the cancellation of a recurring billing commitment.

1.3  This Policy should be read alongside the Terms & Conditions, Refund Policy, and Payment Policy, all available at pic-wave.com. In the event of conflict, the Terms & Conditions shall prevail.

1.4  Defined terms used in this Policy have the same meanings as in the Terms & Conditions.

2. Nature of the Service & Purchases

2.1  All Picwave purchases — Digital Images and Token Packs — are one-time transactions. There is no subscription, recurring billing, or automatic renewal associated with your Account.

2.2  Your Account is a personal account that stores your Token balance, order history, and access to the Generate Module. Maintaining an Account is free; costs are incurred only when you make a purchase.

2.3  Tokens purchased and credited to your Account are a prepaid entitlement to use the Generate Module. They are not money, stored value, or redeemable currency, and their treatment on Account closure is described in Section 9.

3. Ways a User May Cancel / Close an Account

3.1  You may close your Account at any time, subject to this Policy, through any of the following methods:

  • Self-service: log into your Account at pic-wave.com/my-account and navigate to account settings to initiate the deletion or closure process.
  • Email request: send an email to info@pic-wave.com from your registered email address with the subject line “Account Closure Request” and confirm you wish to close the Account. We will process the closure within 5 business days.

3.2  Account closure requests must come from the registered email address associated with the Account. Requests from unverified sources will not be processed without identity verification.

3.3  If you cannot access your Account due to forgotten credentials, contact info@pic-wave.com to initiate account recovery before requesting closure.

4. Effective Time of a User Cancellation

4.1  Where you close your Account through the self-service portal, the closure takes effect immediately upon confirmation. Access to the Service (including the Generate Module and any remaining Token balance) is terminated at that moment.

4.2  Where you request closure by email, the closure takes effect within 5 business days of our confirming the request in writing. You will receive a closure confirmation email.

4.3  Between the date of a closure request and the effective date, your Account remains accessible for any refund requests under the Refund Policy. No new purchases should be made after initiating a closure request.

5. Consequences of Voluntary Closure

5.1  Upon closure of your Account:

  • All access to the Service, including the Generate Module, is terminated.
  • Your remaining Token balance is permanently forfeited (see Section 9 for full details).
  • Your order history is retained by Picwave for accounting, legal, and audit purposes in accordance with the Privacy Policy, but will no longer be accessible to you through the Account portal.
  • Previously downloaded Digital Images remain licensed for use in your existing projects, subject to the terms of Section 5 of the Terms & Conditions. The licence is not retroactively revoked solely by Account closure.

5.2  Picwave will process any pending Orders (for which payment has already been confirmed) before or shortly after Account closure; contact us at info@pic-wave.com if you have a pending Order and wish to close your Account.

6. No Automatic Refund on Cancellation

6.1  Voluntary closure of your Account does not automatically entitle you to a refund of any outstanding Token balance or unused digital goods. Refunds on closure are governed by the Refund Policy.

6.2  If you believe you are entitled to a refund of your unconsumed Token balance before closing your Account, you must submit a refund request under the Refund Policy prior to initiating Account closure. Once the Account is closed, any remaining balance is forfeited without compensation, except as provided in Section 5.2 and Section 8.

6.3  This position is consistent with the nature of Tokens as prepaid, non-redeemable usage credits, as described in the Terms & Conditions.

7. Company-Initiated Suspension / Restriction / Termination

7.1  Picwave may suspend, restrict, or terminate your Account without prior notice in any of the following circumstances:

  • You have materially or repeatedly breached these Terms, the Terms & Conditions, or the Acceptable Use Policy.
  • Picwave reasonably suspects fraudulent activity, chargeback abuse, or other conduct harmful to the platform or other users.
  • Picwave is required to do so by a court order, regulator, or applicable law.
  • Your Account has been compromised and suspension is necessary to protect you or other users.

7.2  Where suspension is imposed for investigation rather than confirmed breach, Picwave will notify you by email and allow you to respond within a reasonable period (typically 5 business days). If the investigation resolves in your favour, access will be restored.

7.3  Where termination is imposed for confirmed breach, the consequences described in Section 14 of the Terms & Conditions apply.

8. Effect of Fraud / Abuse / Disputes on Cancellation

8.1  Where Picwave terminates your Account for breach, fraud, or repeated chargeback abuse: (a) any remaining Token balance is forfeited; (b) Picwave reserves the right to seek compensation for losses caused by your conduct; (c) Picwave may report the matter to relevant card schemes, law enforcement, or regulatory authorities.

8.2  Where Picwave closes your Account for reasons not related to your conduct (for example, because Picwave is discontinuing the Service), Picwave will: (a) provide at least 30 days’ advance notice; (b) consider a refund of unconsumed Tokens in accordance with the Refund Policy.

9. Treatment of Virtual Currency / Items / Digital Entitlements

9.1  Tokens. Upon closure of your Account — whether by you voluntarily or by Picwave for breach — any Tokens remaining in your Account balance are permanently extinguished. Tokens: (a) have no cash value and cannot be redeemed for money; (b) cannot be transferred to another Account; (c) cannot be carried over to a new Account opened after closure; (d) are not compensated in cash unless Picwave closes your Account for non-breach reasons and approves a refund under the Refund Policy.

9.2  Digital Images. Digital Images previously purchased and downloaded remain licensed for use in existing projects after Account closure, subject to the Licence terms in Section 5 of the Terms & Conditions. The Licence is not retroactively revoked solely by Account closure.

9.3  Generation history. Your prompt history and generated image log, accessible through the Account, are deleted or de-personalised following Account closure in accordance with the Privacy Policy retention schedule.

9.4  No entitlement to restoration. Tokens forfeited on closure cannot be restored if you re-register. Each Account is independent; a new Account starts with zero Token balance.

10. Guest Access / Dormant / Inactivity

10.1  Picwave does not currently offer guest checkout without Account registration. All purchasers must hold an Account.

10.2  Dormant accounts (those with no login or purchase activity for an extended period) are not automatically closed. Picwave may contact you by email if your Account has been dormant for more than 24 months to confirm whether you wish to keep it active.

10.3  If you do not respond to a dormancy notification within 30 days, Picwave reserves the right to close the Account, with prior email notice. In such a case, any remaining Token balance will be treated as a non-breach closure as described in Section 8.2.

11. Deletion of Personal Data vs Closure of Access

11.1  Account closure means termination of your access to the Service. It does not automatically result in immediate deletion of all personal data associated with your Account, as some data must be retained for legal compliance purposes (for example, financial transaction records for 7 years under Estonian accounting law).

11.2  You have the right to request deletion of your personal data under the GDPR (right to erasure), subject to legal retention obligations. This right is separate from Account closure and must be exercised through a specific data-subject request to info@pic-wave.com. See the Privacy Policy for full details.

11.3  Picwave will delete or anonymise your personal data as soon as permitted by applicable law following Account closure, in accordance with the retention schedule in Schedule 1 of the Privacy Policy.

12. Service Retirement / Major Changes / Sunset

12.1  If Picwave decides to retire or permanently discontinue the Service, or a major component of it (such as the Generate Module), we will: (a) provide at least 30 days’ advance written notice to all registered Account holders by email; (b) allow users to access and download previously purchased Digital Images for the duration of the notice period; (c) consider a refund of unconsumed Token balances in accordance with the Refund Policy.

12.2  Major changes to the Service that materially affect the value of purchased Tokens or the availability of Digital Images will be notified to users with reasonable advance notice.

13. Cooling-Off & Mandatory Consumer Rights

13.1  As described in the Terms & Conditions and Refund Policy, the 14-day statutory right of withdrawal for distance contracts applies to Picwave purchases but is typically disapplied in respect of digital content that has been supplied immediately with the consumer’s prior consent and acknowledgement of loss of the withdrawal right.

13.2  Nothing in this Cancellation Policy removes or limits any statutory consumer rights that cannot lawfully be excluded under EU or Estonian consumer law.

14. Reopening / Restoration / New Accounts

14.1  Once an Account is closed, it cannot be restored. Any forfeited Token balance is not recoverable through reopening.

14.2  You may register a new Account at any time after closure. A new Account starts with no Token balance. Previously purchased Digital Images remain licensed but are not re-associated with the new Account.

14.3  Where an Account was terminated by Picwave for breach, re-registration may be refused. Picwave reserves the right to decline Account registration to individuals who have previously been terminated for breach.

15. Communications & Support

15.1  Picwave will communicate Account closure confirmation, suspension notices, and related matters to the email address registered to your Account. It is your responsibility to keep your email address current.

15.2  Support for closure-related queries: info@pic-wave.com, subject: “Account Closure”. Response within 2 business days.

16. Changes

16.1  This Cancellation Policy may be updated from time to time. Material changes will be notified by email or website notice at least 14 days before taking effect. The current version is always available at pic-wave.com.

17.1  This Cancellation Policy is governed by the laws of the Republic of Estonia and EU law where applicable.
